Know all man by these presents [?] that I, James Somerville, of the village of Lucknow, in the County of Huron and Province of Canada, Millright, am held and firmly bound onto Walter Treleavin [sic] of the township of Ashfield in the County and Province foresaid, yeoman, in the _something?_ sum of Six thousand dollars for which payment well and truly to be made. I bind myself, my heirs, electors, administrators and _something_ firmly by these presents[?]. Sealed with my seale and dated this tenth day of September in the Year of our Lord One thousand, eight hundred and Sixty three.
Now the Conditions of this obligation is such that if the above _something?_ James Sommerville never build a flour or Grist Mill or a Saw Mill for the Manufacture and sale of lumber on the Water Power held by him on the Nine Mile River in the Village of Lucknow while the above named Walter Treleavin [sic] owns the Grist and Saw Mill in the Village of Lucknow, then the above obligation to be null and void if not to be and remain in full force and virtue.
