Mary Nye

29/12/1851, conditional pardon retended, Charles Nye- Argyle. I have no idea what that means.The Cornwall Chronicle 3/1/1852
Charles Nye arrested on warrant was charged by his master Mr H D Parr with having absented himself from work without leave. The charge was allowed to be withdrawn. Launceston Examiner 8/4/1873. This is long after Charles was granted a conditional pardon in 1851 so what did he do to have been working for a master in 1873. In 1857 he was a constable. Something has gone wrong in the meantime.
Ah ha. He was transported for life so he wasn’t able to get a conditional pardon. Is that it? Life was life back then.
Not sure if I’m a fan of Mr HD Parr. Charles is not the only one he had arrested for being away from his job without permission. He was the publican of the Royal Hotel at Launceston, a race horse breeder and cancer cure charleton who would not pass on his secret cure. When he heard that his father was dying back in England he sold all his interests in Tasmania, travelled back home to claim his share of Dads estate. When he got there Dad had already passed on....intestate.....and everything went to his older brother.....I do like a happy ending. ;)

There is a story out there about Mary Nye but I think it’s all fiction. It was printed in a magazine a number of years ago. It’s the one where her photo in the check shawl appears. I have lots of doubts about it. Not sure and don’t know what to think.
All this leads us back to post #1 and going around in circles.

Marriage permissions in 1843 for Charles Nye state he was per Argyle and Mary Adams was per G. Grove (Garland Grove) however when they married one year later in 1844 they stated that they were free. Naughty, naughty. :mad:

But under intestacy rules the estate should have been shared equally among all surviving children :confused:

The older brother may well be named in the probate index, if he was on hand to act as Administrator, but if he kept all the dosh the younger brother would have been able to claim his share, in court if necessary. The only way for the younger one to be prevented from having his share would have been for the father to make a will specifically excluding him, or else including him with just a token amount.
 
My apologies....the article states that the father died without making a will and the property ‘reverted’ by law to the older brother.
I have no idea of the legalities, just reading a newspaper report.
 
I thought, as in the newspaper report, this was usual form for the real
estate to descend that way. The question is when was the law changed
to share the estate?
 
You've got me, I think. I'd forgotten about the distinction between real and personal estate, and that in most of England real estate passed automatically to the eldest son.

As for when this changed, it might have been under the Administration of Estates Act 1925, but it would take me a long time to read up on this, and someone else might already know (he says hopefully).
 
The more I look the more I think that Mary Nye is actually Mary Bird aka Wilson. Where the Fleming comes from I’m still working on that. The only thing that worries me is that Mary Wilson married Acton in 1852 but Mary Bird/Wilson and her background of being brought up in a brothel and her drunkenness fit so well with the behaviour of Mary Nye. Mary Birds convict reports show her to be an incorrigible drunk from the time she arrived and before. There is only one Mary Nye reported in the papers and the burial of Mary Nye nee Adams I think is wrong. Researchers worked on those convict burials at Cornelia Bay and the death registration has no hint as to her parents. The burial says she was from England. The death registration says Ireland so who knows.
Maybe Mary Wilson who was still married to Acton, then married Charles Nye as Mary Fleming, bigamously. I wouldn’t put it past her.

I only just seen these posts, I’m sorry I haven’t replied earlier.
I researched Mary Wilson and thought the same, it’s very confusing. Who is Mary Fleming??
 
I have now found the burials of both John Nye and his wife
Kate/Kitty.
She is Kate in the GRO Index for 1850 Brighthelmstone
At St Nicholas, Brighton
1850 Aug 3 Kitty NYE 74 of North Lane
1847 Apr 19 John NYE 73 of North Lane

As John was not there with Kitty in the '41 Census, I had
wrongly assumed he had died somewhere between 1836
and 1841. So still to find John in 1841 Census.

Daughter Kitty is buried as Catherine Shelley at St Nicholas
1829 Feb 24 31, Bond St.
Husband William remarries Elizabeth Julia Myers later that
year. They are to be found in 1851 at St Pauls, Benet Wharf,
London.

Wonderful Burt, isn’t it funny how significant dates consistently pop up and it makes you think you are doing the right thing searching for family, like a little hint you are in the right track. My birthday is the 3rd Aug, Catharine died on 3rd Aug and her son Charles arrived in Tasmania on the Argyle 3rd Aug. I’m feeling very special and very grateful for all this help.
Tell me, I have Johns birth year as 1785 yet his oldest child Kitty was born in 1798, could he have been that young?

I am working on John's birth, Will let you know.
He should have been born 1774 according to his death,
but at the moment I have one for 1781! Hope the
original says he was 5 years old at baptism!
Seems he was with what I believe was a nephew
James Gratwick at Henfield in 1841.

Descendants of Kitty Nye and William Shelley, shoemaker, emigrated to Victoria. A publican of the North Richmond hotel, mined at Ballarat and a mayor of Richmond. (Oxlade family via Victoria) justd.com
